As usual, the annual report not only provides insight into the work, of the Council but also contains several critical reflections on developments during the reporting year. In his foreword, the President of the Council reflects on the consequences of the COVID-19 pandemic and its impact on the world, the Kingdom of the Netherlands, and Aruba. In addition to the resistance and (sometimes) opposition that the measures taken to combat the coronavirus are evoking among citizens worldwide, the President notes that there is now also momentum towards achieving Sustainable Development Goals, particularly in the areas of sustainability and climate.
With the theme of the annual report "Legal Safeguards in a Time of Pandemic", the Council offers a reflection on the constitutional limits of emergency legislation. The central question is whether and to what extent in a constitutional context the fundamental rights of citizens can be restricted through emergency legislation. The Council believes that in case of the continuation of a special situation whereby special powers are exercised for a longer period, they should be provided with a more robust legal basis and be covered with more guarantees.
Finally, in light of the government-wide budget cuts necessary to combat the COVID-19 crisis, it was felt that the design of the 2020 Annual Report should be sober.
