Therefore, the Department of Labor and Research (DAO) wishes to assess the employment situation and approaches all companies to submit a Personnel Register COVID2020.
Under Article 30, the first paragraph, of the Labor Ordinance 2013, employers are obliged to provide the Personnel Register (PR) to the Department of Labor and Research (DAO) upon request.
The Personnel Register consists of 3 parts:
- Model 1A: the current staff working or registered at your company as of June 30, 2020;
- Model 1B: the staffing needs of the last six months of 2020, hence from July to December 2020, taking into account the actual state of our economy;
- Model 1C: the personnel needs associated with specific projects for the last six months of 2020;
Below you will find the required form:
Submission of the Personnel Register COVID2020 is mandatory for all companies and must be submitted during the period from July 10, 2020, to August 9, 2020.
Submission of personnel register COVID2020
The COVID 2020 Personnel Register must only be submitted digitally. It is also possible to request the form, consisting of three pages via the e-mail address: email@example.com, and DAO will e-mail the form to you.
In case a company has one or more branches, DAO requests to fill out the Personnel Register form, not only for the head office (e.g. Chamber of Commerce number 5555.0) but also for each branch (e.g. (PE Chamber of Commerce number 5555.1, 5555.2, etc.) You must also place an asterisk (*) in the column (after column no. on the form) to indicate which employee is rotated at your branches.
It is mandatory to fill out all 3 models. In case you do not require personnel, or a need for persons for each specific project in 2020, you should not enter this on model 1B and model 1C.
Where and how can the personnel register COVID2020 be submitted
DAO requests all companies to complete the digital form completely, according to the legally established models and to send it to the e-mail address: firstname.lastname@example.org.
DAO will then send you a receipt for your Personnel Register form COVID2020 by email. Keep in mind that if you have already submitted the Personnel Register 2010-2020, you must also submit the Personnel Register COVID2020.
If a personnel register COVID2020 has been filled in incorrectly, and the DAO has pointed this out to the company, but the company has failed to amend the personnel register, this will also be considered a non-compliance.
DAO would like to remind companies that use intermediaries (eg accounting or consultancy) that compliance with our labor laws is a duty of the employer and not of the intermediary. Companies that do not submit the personnel register COVID2020 within the said period, as well as those who did not submit the personnel register in the previous year, are in default under Article 30 of the Labor Ordinance 2013. DAO will take measures after August 9, 2020.
The company will be fined Awg. 5000, - for failure to comply with the obligation to submit the Personnel Register COVID 2020.
